DISCLAIMERS AND LIMITATION OF LIABILITY: THE WEBSITE IS PROVIDED "AS IS" AND "AS AVAILABLE". USE OF THE WEBSITE IS AT YOUR OWN RISK. THE WEBSITE MAY BE TEMPORARILY UNAVAILABLE AT TIMES FOR MAINTENANCE AND UPGRADES WITHOUT NOTICE. SNAPGRADES MAY CHANGE OR DISCONTINUE ANY ASPECT OF THE WEBSITE WITHOUT NOTICE, INCLUDING BUT NOT LIMITED TO FEATURES AND BROWSER REQUIREMENTS. Legal Use: You may not use the Website for any unlawful activities. You agree to use the Website only for its stated purpose. You agree not to use the Website to upload or email content for commercial purposes. You agree not to intentionally damage or overburden the Website.

Proprietary Rights, Copyrights & Trademarks: You agree not to duplicate, publish, modify, or reverse engineer any portion of the Website. You agree not to resell use of the Website or any portion of it or exploit it for commercial gain. "SnapGrades" and the SnapGrades logo are trademarks of SnapGrades.

Children's Online Privacy Protection Act (COPPA): Teachers may optionally use the Website to collect personal information from Students. U.S. Federal law requires that Teachers obtain Parents' consent before collecting personal information online from Students under the age of 13. You agree that SnapGrades shall not be liable for how Teachers collect and use Students' personal information.

Family Educational Rights & Privacy Act (FERPA): U.S. Federal law requires certain student information to be kept private, but available to parents. SnapGrades provides several security features to protect the privacy of students' grades and other data. You agree that the School or Teacher is responsible for using these features to comply with legal requirements, and SnapGrades shall not be liable. SnapGrades will not use any personally identifiable student data, nor share it with any third party.

User License: Payment of a subscription fee grants you a personal, non-exclusive, non-assignable, and non-transferable license to access the Website. You may not share or transfer your user identity or password, and you must keep your password confidential.

Termination: Your access to the Website may be terminated if you violate the Terms of Use, allow your subscription or trial to expire, or fail to pay for your subscription. Your access may be terminated if there is reason to believe you provided false personal information or are posing as someone else.

Restricted Access & Data Storage: Your data may be deleted after your subscription or trial expires. It is your responsibility to keep your own archival records (such as exported data files or printouts). If your data exceeds storage limitations you may be asked to delete some of it, or SnapGrades may delete some of it with advance notice. SnapGrades may delete any data that violates the Terms of Service. Your access may be limited or denied if you exceed bandwidth limitations.

Comments & Submissions: SnapGrades welcomes comments and suggestions. Anything you submit or communicate to SnapGrades becomes the property of SnapGrades and may be quoted and published unless you explicitly request otherwise in advance.

Controlling Law: This Agreement shall be construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any cause of action of any nature arising out this Agreement shall be brought in Santa Clara County.

Amendments: These Terms of Service and Privacy Statement may be amended occasionally with or without notice. Any revisions are effective immediately once posted on SnapGrades.net. Your continued use of the Website shall indicate your acceptance of the revision.
